  1. Introduction

Welcome to TinchApp, a car rental marketplace operated by Tinch HEC Technologies Ltd. By registering as a Host on our platform, you agree to the following terms and conditions. These Terms and Conditions (“Terms”) govern the relationship between Tinch HEC Technologies Ltd., trading under the brand name TinchApp (“TinchApp”, “we”, “us”, or “our”) and you, the Vehicle Owner or Rental Agency (“Host”, “you”, or “your”) who lists vehicle(s) on the TinchApp platform (“Platform”).

  1. Definitions
  • Platform: The TinchApp website (tinchapp.com), mobile application and social media accounts where Hosts list vehicles and renters book rentals.
  • Vehicle: A car, van, truck, or other motor vehicle listed for rent on the Platform.
  • Listing: The information and pictures uploaded by the Host describing a Vehicle and requirements for rental on the Platform.
  • Rental: A confirmed booking for a Vehicle on the Platform by a Renter.
  • Renter: An individual or business who rents a Vehicle through the Platform.
  1. Vehicle Listing and Requirements

3.1. Accuracy and Completeness: The Host is responsible for ensuring that all Listings are accurate, complete, and up-to-date. This includes:

* Vehicle details such as make, model, year, features, mileage, and fuel type.

* High-quality pictures showcasing the Vehicle’s exterior and interior condition.

* Any specific restrictions on use (e.g., mileage limitations, usage areas, smoking restrictions).

3.2. Review and Approval: TinchApp will review all Listings within 24-72 working hours upon submission. Listings that meet our standards will be approved and published on the Platform. We reserve the right to reject any Listing that does not comply with these Terms or our listing guidelines.

3.3. Vehicle Condition: Host responsible for ensuring that all Vehicles listed for rent are in good working condition, clean, and properly maintained. Vehicles must meet all Ghanaian safety and roadworthiness standards. Specific requirements for listing on TinchApp are as follows;

  • Vehicles must be less than 10 years old. (inspections are required for cars older than 10 years).
  • Vehicles mileage must be less than 200,000 (inspections are required for cars ≥125,000 mileage).
  • Comprehensive Insurance Cover and Road Worthiness Certificate.

3.4 Ownership: The Host hereby confirms that he is the bonafide owner or has explicit right, authority and approval of the owner to list the vehicle(s) on the TinchApp platform.

  1. Pricing and Availability

4.1. Pricing: The Host is responsible for setting and updating the rental prices for the listed Vehicles on the Platform. Prices should be clear and inclusive of any applicable charges and fees. Hosts are encouraged to use the recommended pricing as this is based on market data.

4.2. Out of Zone Pricing: The Host shall indicate a fixed price, on predefined Regional basis, for clients intending to use vehicles out of the rental Region.

4.3. Tax: The Host is responsible for paying all taxes and fees associated with the rental of the listed vehicle.

4.4. Availability: Hosts are responsible for updating the availability status of their listed vehicles daily on the platform. Failure to update vehicle status may impact Host score and access to the platform.

  1. Insurance and Tracking

5.1. Insurance: You are required to maintain comprehensive insurance on all Vehicles listed on the Platform. This insurance should cover damage to the Vehicle, liability for third-party injuries, and theft.

5.2. Vehicle Tracking: You are strongly encouraged to equip all Vehicles with a GPS tracking device. This will assist in locating the Vehicle in case of theft and ensure accurate odometer readings.

  1. Order Acceptance and Management

6.1. Order Response: You are obligated to accept or reject rental requests within 5 minutes of receiving them through the Platform. Failure to respond to orders on time may affect your Host Score and service delivery to clients.

6.2. Order Fulfillment: Once you accept a rental request, you are responsible for fulfilling the order with the specific Vehicle displayed on the Platform and cannot substitute a different vehicle without prior express approval and consent from TinchApp.

6.3. Availability Management: You are responsible for ensuring that the availability status (available or rented) for your Vehicles is updated daily on the Platform to provide accurate information to potential renters.

  1. Delivery and Pickup

7.1. Delivery and Pickup Responsibilities: You are responsible for either delivering the Vehicle to the Renter; if the Renter selects this option; or arranging for pickup at the designated location you indicated on the platform. You are also responsible for pickup or receiving the vehicle at the end of the rental period.

7.2. TinchApp may offer to assist with either delivery or pickup of your vehicles to clients, at which instance the delivery charges paid by the customer is transferable to TinchApp.

  1. Payment and Fees

8.1. Payment Processing: TinchApp will handle all payment processing for Rentals on the Platform. Payments will be released to you within 48 hours after the rental confirmation.

8.2 Security Deposit: Any security deposit shall be retained by TinchApp and appropriately allocated to the Host to cover any predefined cost arising from the rental or refunded to the client if no infringement occurs.

8.3. Fees: You agree to pay any applicable fees associated with using the Platform, such as listing fees, commission on rentals, or other service charges as may be surcharged and/or communicated.

8.4 Host Commission Package: You hereby agree to be placed on the  (Standard Pack, Premium Pack, Power Pack) which shall determine your commission payment to TinchApp. TinchApp reserves the right to reclassify or redefine any of the packages attached as appendix I, below.

  1. Limitation of Liability

9.1. TinchApp is not liable for any loss, damage, or injury arising from the use of Vehicles rented through the Platform. The Host assumes full responsibility for the condition and safety of their Vehicles.

  1. Client Data Protection

10.1. Data Security: You are responsible for maintaining the confidentiality and security of all Renter data you obtain through the Platform. You must comply with all applicable data protection laws and regulations. You are prohibited from using Renter data for any purpose other than facilitating the particular rental transaction.

  1. Prohibited Activities

11.1. Direct Sales: You are prohibited from directly soliciting the Renter for any additional services not booked through the Platform during or after the rental period.

11.2. Platform Manipulation: You are prohibited from manipulating the Platform or engaging in any activity that disrupts its operation.

  1. Term and Termination

12.1. These Terms will remain in effect until terminated by either party.

12.2. Hosts may terminate their accounts by providing 30 days’ written notice, subject to the completion of any outstanding rental obligations.

12.3 TinchApp may suspend or terminate a Host’s account for violations of these Terms, fraudulent activities, or actions detrimental to the Platform’s integrity.

  1. Governing Law and Dispute Resolution

13.1 These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes shall first be resolved amicably, failing which they may be submitted to arbitration under Ghanaian law.

  1. Amendments

14.1 TinchApp reserves the right to amend these Terms at any time. Hosts will be notified of significant changes and are required to accept the updated Terms to continue using the Platform.

By using the TinchApp Platform, you acknowledge and agree to these Terms.
